1. Your rights

Access your health records

You may ask to inspect or obtain an electronic or paper copy of your medical records and other health information in our designated record set, subject to exceptions permitted by law.

We generally respond within 30 days. If an extension is permitted and needed, we will explain the reason and expected completion date in writing. A reasonable, cost-based fee may apply where permitted.

Certain records, including separately maintained psychotherapy notes, are excluded from the HIPAA right of access. If we deny a request, we will explain the reason and any available review rights.

Request a correction

You may request an amendment if you believe information in your records is incorrect or incomplete.

We generally respond within 60 days. If we deny your request, we will explain why in writing and explain how you may submit a statement of disagreement.

Request confidential communications

You may ask us to contact you in a particular way or at a different location, for example, by using a specific telephone number or mailing address.

We will accommodate reasonable requests.

Request limits on use or disclosure

You may ask us to restrict how we use or disclose your health information for treatment, payment, or healthcare operations, or to people involved in your care.

We generally do not have to agree, except as required by law. If we agree, we will follow the restriction, subject to permitted exceptions such as emergency treatment.

If you pay for a healthcare item or service out of pocket in full, you may ask us not to disclose information about that item or service to your health plan for payment or healthcare operations. We must honor that request unless disclosure is required by law.

Receive an accounting of disclosures

You may request a list of certain disclosures made during the six years before your request.

The accounting excludes disclosures that do not have to be listed under HIPAA, including many disclosures for treatment, payment, healthcare operations, or pursuant to your authorization.

The first accounting in a 12-month period is free. We may charge a reasonable, cost-based fee for additional requests during that period, after notifying you and giving you an opportunity to withdraw or modify the request.

Obtain a copy of this notice

You may request a paper copy at any time, even if you previously agreed to receive it electronically.

Have an authorized representative act for you

A person legally authorized to act as your personal representative may exercise applicable rights on your behalf. We will verify that person’s authority and apply any legal exceptions or limitations.

Make a complaint

You may complain to our privacy contact if you believe your privacy rights have been violated.

You may also file a complaint with the U.S. Department of Health and Human Services, Office for Civil Rights:

Online: https://www.hhs.gov/hipaa/filing-a-complaint/index.html
Telephone: 1-877-696-6775
Mail: 200 Independence Avenue, S.W., Washington, D.C. 20201

We will not retaliate against you for making a complaint or exercising your rights.

2. How we may use and disclose your information

The following describes uses and disclosures HIPAA permits. Additional federal or state restrictions may apply, particularly to certain mental health and substance use disorder records.

Treatment

We may use and disclose your information to provide, coordinate, or manage your care.

For example, we may discuss your medications with your pharmacist or coordinate treatment with another healthcare professional involved in your care.

Payment

We may use and disclose information to obtain payment for services.

For example, we may provide information to your insurer to verify coverage, obtain authorization, or process a claim.

Healthcare operations

We may use and disclose information to operate our practice, review the quality of care, conduct permitted administrative activities, and contact you about your care.

For example, we may review records to improve our services or arrange appointment reminders.

Service providers

We may share information with service providers that perform functions for us, such as billing, record storage, or technology support. When required, these providers must enter into agreements to safeguard the information and limit its use and disclosure.

Public health and safety

When permitted or required by law, we may disclose information for purposes such as:

  • Preventing or controlling disease.

  • Reporting adverse medication reactions or product problems.

  • Reporting suspected abuse, neglect, or domestic violence.

  • Preventing or reducing a serious and imminent threat to health or safety.

Legal requirements and oversight

We may disclose information when required by law, including to HHS to evaluate compliance with privacy requirements.

We may also disclose information for legally authorized oversight activities, such as audits, investigations, inspections, or licensing reviews.

Judicial proceedings and law enforcement

We may disclose information in response to court or administrative orders, or to subpoenas and other lawful requests, only when applicable legal requirements are satisfied.

A request from a court, attorney, or law enforcement agency does not automatically permit unrestricted access to your records.

Research

We may use or disclose information for research when applicable legal conditions are met, such as obtaining your authorization or an approved waiver.

Other legally permitted purposes

Subject to applicable restrictions, information may be disclosed for workers’ compensation, organ or tissue donation, duties of coroners, medical examiners or funeral directors, and authorized military, national security, protective-service, or correctional purposes.

3. Family, friends, and others involved in your care

We may share relevant information with people involved in your care or payment for your care when you agree, have an opportunity to object and do not, or when the law otherwise permits.

If you cannot express a preference, we may use professional judgment to make a limited disclosure in your best interests, where permitted by law.

We may also share limited information for disaster relief or to address a serious and imminent threat, subject to applicable legal requirements.

Tell us if you have preferences about who may receive information.

4. Uses that require written authorization

We will obtain your written authorization for uses or disclosures that require it, including:

  • Most uses and disclosures of separately maintained psychotherapy notes.

  • Marketing communications that require authorization under HIPAA.

  • Disclosures that constitute a sale of protected health information under HIPAA.

  • Other uses and disclosures not described in this notice unless otherwise permitted or required by law.

You may revoke an authorization in writing through our privacy contact. Revocation does not undo actions already taken in reliance on the authorization or other exceptions permitted by law.

5. Additional protections for sensitive records

Psychotherapy notes

Psychotherapy notes have a specific meaning under HIPAA and are not the same as all mental health records or routine clinical progress notes.

If we maintain these separately protected notes, most uses and disclosures require your written authorization, subject to limited legal exceptions.

Substance use disorder records

If we hold substance use disorder patient records protected by 42 CFR Part 2, additional restrictions apply.

We will not use or disclose those records in civil, criminal, administrative, or legislative investigations or proceedings against you without your written consent or a court order and a subpoena, as required by applicable law.

These protections apply even when a disclosure might otherwise be permitted under the general provisions above.

Additional state-law protections

Where applicable state or federal law provides greater privacy protection than HIPAA, we will follow the more protective requirements.

6. Our responsibilities

We are required by law to:

  • Maintain the privacy and security of your protected health information.

  • Give you this notice describing our legal duties and privacy practices.

  • Follow the terms of the notice currently in effect.

  • Notify you as required by law if a breach of unsecured protected health information occurs.

We will obtain your written authorization when required before using or disclosing information for purposes beyond those described in this notice.

7. Changes to this notice

We may change this notice as permitted by law. Revised terms may apply to information we already maintain as well as information received in the future.

The current notice will be available on our website and upon request. Each revised notice will show its effective date.
